Marion County Clerk of Court

The Honorable Christy M. Gray is the Marion County Clerk of Court. She was elected November 8, 2016, and took office January 3, 2017. Before becoming Clerk, she worked as Chief Deputy Clerk of Court and in the General Sessions division of the office. She also worked in Family Court from 1992 to 1995. Her deep background in court operations brings firsthand knowledge to the management of Marion County court records.

Marion County Circuit Court Records

Marion County is part of the 12th Judicial Circuit. The Circuit Court operates through two divisions. Common Pleas handles civil cases, including personal injury claims, contract disputes, property matters, and civil appeals. General Sessions handles felony criminal charges and serious criminal appeals from Magistrate Court. Circuit Court judges H. S. DeBerry, IV and William H. Seals, Jr. serve Marion County as resident judges of the 12th Circuit.

Civil case filings in Marion County Circuit Court carry a $150.00 filing fee for a summons and complaint. Other fees apply for motions and specialized filings. The fee schedule follows state law under the SC Code. Certified copies of court documents cost $5.00 each. Marion County Family Court Records

The Family Court in Marion County handles divorce, child custody, child support, adoption, juvenile delinquency, and domestic violence matters. Family Court is held at 1305 N. Family Court records in Marion County are public, with the exception of juvenile records and adoption files, which are sealed. To access records or get certified copies, contact the Clerk of Court office. Mediation is available for domestic cases and many disputes are resolved before trial. Child support enforcement services are available through the county. Juvenile records are sealed and cannot be released to the general public without a court order.

Note: The Family Court is at a different address from the main courthouse. Confirm the location before visiting, especially if you have a hearing scheduled at 1305 N. Main Street rather than 100 S. Main Street.

Marion County Magistrate Court Records

The Marion County Magistrate Court handles traffic violations, criminal misdemeanors, civil cases up to $7,500, bond hearings, and preliminary hearings. Chief Magistrate Felicia J. Magistrate Court hearings are bench trials only. There are no juries at this level. If you disagree with a ruling, you may appeal to the Circuit Court, which will hear the matter completely fresh. Bond Court is reached at (843) 292-5238. Fine payments are accepted at the Magistrate office. Hours are Monday through Friday, 8:30 AM to 5:00 PM. Marion County Probate Court Records

The Marion County Probate Court is run by Judge T. C. Atkinson, III. The physical address is 2523 East Highway 76, Marion, SC 29571. Mailing address is PO Box 583, Marion, SC 29571-0583. Phone: (843) 423-8244. Fax: (843) 431-5026. The Probate Court handles estate administration, wills, guardianships, marriage licenses, and related matters.

Marriage license certified copies from the Marion County Probate Court cost $5.00 each. Estate records are open to the public. Online Probate records are available through the SC Probate Court website. Contact the Probate Court directly for matters involving wills, guardianships, and estates. Hours are Monday through Friday, 8:30 AM to 5:00 PM. The Probate Court operates independently from the Clerk of Court, so requests for Probate records should be directed there, not to the main Clerk's office.

FOIA and Public Access to Marion County Court Records

Most court records in Marion County are open to the public under the South Carolina Freedom of Information Act (§ 30-4-10 et seq.). To make a public records request, submit a written description of the records to the Clerk of Court. The office must respond within 10 business days. If a request is denied, the agency must give a written explanation citing the legal basis. You have the right to appeal any denial.

Government-issued photo ID information is required for the request. Expunged and juvenile records are not available through SLED.
